Delhi HC transfers petition alleging corruption by UP CM to other bench

A petition alleging high level corruption to evade income tax by Uttar Pradesh Chief Minister Mayawati has been filed in the Delhi High Court today.

Justice Rajiv Shakdher transferred the petition to the bench of Chief Justice who hears the regular PILs (Public Interest Litigation). The matter would come up on September 7 before the Chief Justice A P Shah.

The petitioner Sanjay Tiwari Ujala has alleged that BSP supremo Mayawati as the party leader had amassed huge wealth through illegal means. Crores of rupees were brought to the party’s Delhi office situated at Karol Bagh which was then converted into small drafts valuing Rs 15000--18000 each and deposited into Mayawati’s bank accounts.

Ujala has revealed the modus operandi of BSP supremo as how black money is being converted into white money to evade income tax and urged the Court to direct its investigation.

A similar case is pending in the High Court here where IT-officials have challenged the ITAT order that exempted I-tax on crores of rupees stating that the money received is gifts from party workers.

The ITAT gave Mayawati a clean chit in the disproportionate assets case and had accepted her claim that immovable property worth Rs 62.72 lakh and cash payments of Rs two lakh were the gifts given by her supporters out of love and affection.

The Government in its appeal had held her claim as unacceptable and contended that the cash and property presented to Mayawati should be taken as part of her annual income.

Ujala has sought the Court’s intervention to ask CBI or any other investigating agency to probe the matter. He claims that his and his family members life is under threat and he should be provided security.

New Delhi, July 2: Pratibha Patil survived the returning officer’s scrutiny but Sanjay Tiwari Ujala and Manohar Lal Sharma are standing between her and the starting line.

Ujala and Sharma today filed separate petitions challenging Pratibha’s nomination for the election on a range of grounds — from her alleged insolvency that led to the closure of a bank she ran to the charge that she withheld information from the Election Commission.

The charges in the separate petitions are so identical that Ujala has accused Sharma of “plagiarism”.

Ujala filed two petitions before Delhi High Court. The first — a four-liner — seeks a judicial inquiry into various allegations levelled against her and reported in the media.

These include the allegation that a Jalgaon-based cooperative bank her family ran collected money from employees for the Kargil fund, but never transferred the cash to the government. The charge against Pratibha is one of criminal breach of trust under Section 406 of the Indian Penal Code.

The RBI subsequently withdrew the bank’s licence. Loans that the cooperative bank took from other banks have yet to be returned, Ujala’s petition claimed.

The second petition said Pratibha is the trustee of a body of colleges in Maharashtra, called the Shramsadhana Trust. Pratibha, therefore, holds an office other than a government one, making her ineligible for the post of President, Ujala has said.

The director of a recently registered NGO — Indraprastha People — Ujala’s antecedents aren’t well known. Attempts to ask him about his background are met with fierce resistance.

“Why do you ask me' You should be asking Pratibha Patil for her antecedents,” he said.

He has filed at least one petition against another person who was in the news — erstwhile Congress activist Sushil Sharma of the “tandoor murder” case.

Manohar Lal Sharma’s petition before the Supreme Court levels the same charges against Pratibha and will come up for hearing tomorrow.

Ujala has claimed Sharma has “plagiarised” his petitions “for publicity”. “He is doing this for publicity,” Ujala said. He plans to seek the dismissal of Sharma’s petition tomorrow.

 हमारे देश की अधिकतर सरकारी योजनाओं का ५०./. पैसा  सरकारी बाबू. अधिकारी मिलकर खा जाते हैं. जनता  की हालात बद से बदतर है  चिंताजनक है. भोली भाली जनता  कई लाख करोड़ रुपये खा गए छोटे बाबू से लेकर बड़े बाबू तक. नेतावो को तो ५./. सभी तरह के मुक़दमे ट्रायल कोर्ट से ६ महीने में ऊपरी कोर्ट से अपील के बाद १ साल में निस्तारित करने का क़ानून औोर व्यवस्था हो तो अधिकतर अपराध अपने आप अपने आप ख़तम हो जाएगा लेकिन मुकदमों की जांच पुलिस के अलावा कोई अलग एजेंसी करे. जांच अधिकारी किसी भी अवहियुक्त को बचाता है तो उसको भी उसी धरा में सजा हो वो जिस मुकदमे की जांच कर रहा हो. औोर हाँ  जांच. अधिकारी मुकदमो की जांच  एक महीने में करने के लिए बाध्य हो.. संजय तिवारी उजाला
