Ministry today
informed the
Delhi High Court
that it has served
a show cause
notice to UTV
bindas seeking to
ban their
controversial
serial, "emotional
atyachar" as it
was said to be
obscene and infringes into personal privacy of an individual.
The Ministry informed a bench headed by Chief Justice Dipak
Misra that the programme has already been suspended from
UTV bindas so no further proceedings need to be carried on
in the matter.
The petitioner however refuted the claims made by the
ministry alleging that the same tv show is now being shown
with a different name on the same tv channel.
The court had earlier issued notices to the Ministry of
Information and Broadcasting, Chairman of UTV and the
team of reality show "Emotional Atyachaar" on a petition
filed by an NGO which sought ban on the programme,
contending it infringes privacy of an individual.
The court was hearing a Public Interest Litigation(PIL) filed
by Indraprashtha People, an NGO, through its President
Sanjay Tiwari Ujala, who claimed "through this programme,
the TV channel has been hurting the feeling of viewers,
spreading vulgarity and demoting social and moral values in
our society".
'Emotional Atyachar' is violative of the government's
guidelines also, and it is abetment to "organised crime", the
NGO said . It demnded strict legal action against the TV
channel Petitioner had also sought a stay on telecast of
what he described as vulgar content of the programme,
arguing it is promoting homosexuality.
He said telecast of the serial violates the Right to Privacy of
an individual as many real life scenes showed intimate
portions.
